  1. PROGRAMME ORGANIZATION AND ORGANIZER

The following terms and conditions (hereinafter, the "Terms" or “Rules”) regulate the rules for participating in the realme co-creation programme called "2022 REALME UI WIDGET CO-CREATION” (hereinafter the "programme") which is organized by realme;

Participation is voluntary and free of charge, except for internet costs or any other connection costs. You have full authority to choose whether to participate in this programme.

  1. ACCEPTANCE OF THE PROGRAMME’S RULES

2.1 EXPRESS CONSENT OF PARTICIPANTS

By participating in the programme, you are hereby accepting the Programme’s present Rules as well as (ii) realme’s Terms of Use and Privacy Policy.

2.2 THIRD-PARTY APPLICABLE POLICIES AND LIABILITY DISCLAIMER

The Participants fully understand and acknowledge that the external social media platforms used in connection with the programme - including but not limited to Facebook, Twitter, Instagram, etc- do not sponsor, endorse or administer this programme and that they should not be associated with the organization and management of the programme in any way.

In addition, Participants acknowledge and hereby accept that the applicable terms of use and privacy policies of the above-mentioned external social media platform and/or as any third party associated with the programme shall also apply, in addition to the present Terms and policies.

You warrant that you have independent, complete, explicit, and uncontroversial copyright of your submissions and that such submissions do not infringe upon the rights of any third party, including but not limited to the copyright and rights of portrait, reputation, and privacy. Your participation in this programme shall be deemed that you have agreed to this rule. All legal liabilities for any disputes arising from your breach of the aforementioned warranties shall be borne by you. The organizer and its partners shall not assume any liability in this regard. You shall compensate including, without limitation to legal fare, attorney, compensation and reconciliation fee if any damages brought to the organizer.

  1. TERRITORY

The programme is valid in all countries except for Cuba, Iran, North Korea, Sudan, Syria, Venezuela, Crimea and Tamil Nadu of India.

  1. PARTICIPANT’S ELIGIBILITY

In order to participate in the programme, the Participant must have the legal age of the Territory from which he/she participates and have the legal capacity according to the applicable laws of its place of residence. (Hereinafter the “Participant(s) or “You”).

Upon the Organizer’s request, Participant must be able to demonstrate at any time and, within a reasonable period, that he/she meets the necessary above-mentioned conditions to participate in the programme.

The Organizer’s employees and/or their family members up to the second degree or any affiliates or company related to the organization or management of the programme may not participate in the programme.

Where Inaccurate or erroneous data are provided by the Participant, the Organizer reserves the right to reject or disqualify the Participant from the programme and so without giving any reasons or notice.

  1. TERM

The programme will start on 00:00 (UCT) [Oct 19th] 2022 and end on 2:00 (UTC) [Nov 15th] 2022 (hereinafter the “Term”).

  1. PARTICIPATION MECHANISM

6.1 GENERAL PROVISIONS OF THE PROGRAMME

The “2022 REALME UI WIDGET CO-CREATION” is a Create Reality themed programme where Participants are invited to upload idea(s).( hereinafter “the Entry”). The Entry will be judged by official realme. Moreover Participants who created creative entry will have the chance to have their entries selected for featured idea on official realme social media and community platforms.

6.2 PROGRAMME ELIGIBLE

To be eligible, the entry shall be original work and shall match the programme’s theme “Creat Reality”, illustrating the creative ideas of the Participants.

Moreover the Entry shall meet the following requirements:

(i) The design elements of widget should combine a capability of the system with an arbitrary real-world element.

(ii) Design specifications:   

  1. Widget size: support 2*2, 2*4, 4*4 three card sizes
  2. Information to be submitted: Sample image (support hand-painted),Features,Combined element selection, Widget name
  3. Interaction area: 2*2 size widget should have less than 4 interaction targets, 2*4, 4*4 widget should have less than 8 interaction targets

(iii) Please download the co-creation template first, and complete the entry and related design according to the template.

We support PDF, DOC, DOCX, PNG, JPG, JPEG, and GIF formats.

6.3 PROGRAMME TIMELINE

Work Submission on 19th Oct. 2022 - 15th Nov. 2022.

Official realme Review on 16th Nov. 2022 - 7th Dec. 2022.

Winner Announcement on 8th Dec. 2022.

  1. OFFICIAL REALME REVIEW

The “Official realme Review” entry period will start on 02:00 (UTC) [November 16th] 2022 and end on 15:59 (UTC) [December 7th] 2022 (hereinafter the “Review Period”).

You may submit multiple entries, you have chances to receive one award for each entry.

After the submission deadline (November 15, 2022), the official realme will determine the adopted entries based on aesthetic composition, creative perspective, underpinning theme and theme relevance in accordance with the standards of justice, professionalism, and rigor. Please note that this program will not result in an idea that will be adopted if there are no proposals that meet the development requirements.

  1. ADOPTED IDEA ANNOUNCEMENT

A adopted ideas list will be published on realme social media and community platforms on 8th December.

(i) The organizer shall contact you if your submissions adopted. In this case, please submit information required by realme. If you fail to do so within the required period or the files you provide do not comply with the rules stated by the organizer, it shall be deemed that you have waived the adopted qualification.

(ii) You agree and acknowledge that you shall provide authentic personal information, include your name, email address, for the purposes of contact and award distribution. The organizer shall collect and process your personal information solely for the aforementioned purposes and to the extent permitted by applicable law. You shall guarantee that the personal information provided by you is complete and accurate. The organizer shall contact you to verify your registration information after award announcement. If an award cannot be distributed to you due to incomplete personal information, it shall be deemed that you have waived the right to claim the award, and no award shall be distributed to you.

(iii) If an award cannot be distributed to you due to your own fault (including but not limited to inaccurate or incomplete contact information such that the organizer is unable to contact you), it shall be deemed that you have waived the right to claim the award. In case of the foregoing, the organizer shall not assume any liabilities arising therefrom, and no award shall be distributed to you. You shall confirm whether the award and bonus are complete upon receipt of them. In case of any abnormalities, you shall inform the sender directly. Unless it is due to willful intent or gross negligence of the organizer, the organizer shall not bear any liabilities for any accidents suffered by you arising from receipt or use of the award.

(iv) In the event that the award cannot be presented due to unforeseen circumstances, the organizer has the right to distribute an award of equivalent value as an alternative.

(v) All images of the awards are for your reference only. The actual award may vary. In case of quality issues, you shall contact the award manufacturer or designated distributor directly and follow their return, replacement, and repair rules. Unless the organizer is the award manufacturer, the organizer shall not assume any responsibilities or liabilities for any of the aforementioned quality issues.

(vi) You shall assume the personal income taxes, value added tax and relevant levies incurred as a result of this programme and such taxes shall be borne by yourself. You shall cooperate with organizer to declare and pay the taxes (if any). The organizer shall bear domestic and international freight costs incurred for shipping the awards.

  1. SELECTION OF WINNERS AND PRIZES

9.1 AWARD AND PRIZES

The official will adopt up to 3 ideas, and the author of the idea will receive one (1) realme GT NEO3 and exclusive community badge.

All submitters will have the opportunity to get the early access of the idea after it is implemented.

9.2 PRIZE TERMS AND CONDITIONS

The colors of physical prizes are chosen at random.

The Prizes which consist in products are not exchangeable in cash and will be subject, if applicable, to the corresponding tax and withholdings.

The Organizer reserves the right, on his own discretion, to substitute the Prize for another of equal value or characteristics, always informing of this circumstance in its media.

  1. INTELLECTUAL PROPERTY AND IMAGE RIGHTS

10.1 ASSIGNMENT OF PARTICIPANTS ITNTELLECTUAL PROPERTY RIGHTS

By participating in the programme, participants authorize the organizer to exploit, commercialize and make available to the public – all within the statutory limits - directly or through its web and/or its social networks, the content created in connection with the programme and use the content (“the entry”) for commercial and/or advertising purposes.

The afore-mentioned authorization is granted on an exclusive and irrevocable basis; in the broadest possible form in law; without any form of remuneration/compensation; for the whole world; for the whole legal life of the rights up to their passage into the public domain; with the capacity to assign to third parties. This authorization will also cover all exploitation rights, including the rights of disclosure and publication, fixation, reproduction, distribution, public communication and making available to the public, the right of transformation and collection right that may correspond to the photo(s) or the work derived from it, as well as industrial property rights and any other rights that may be derived from the photo(s) and/or its elements.

10.2 NON INFRINGMENT OF THIRD PARTY’S RIGHTS

The participants warrant that the material they submit during the programme is their own original work and/or that they hold all necessary rights.

The participant is fully and exclusively responsible for the content of he/she incorporates in the photo(s) and for the photo(s) she/he uploads or communicates through the programme page. The organizer will not be responsible for any infractions and/or violations by the participant in connection with this programme.

10.3 AUTHORISATION OF PARTICIPANT IMAGE RIGHT

Participants irrevocably grant to the Organizer (which expression shall be understood as including realme group companies, parent companies or subsidiaries, affiliates, successors and assigns) and its affiliated partners, the right to use the Participant’s image and name in all forms and media including composite or modified representation including advertising, or any commercial purpose in connection with the Challenge throughout the world and in perpetuity without any compensation.

Participants moreover release the Organizer and its partners from any claims that may arise regarding the use of their image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright.

  1. PERSONAL DATA

Participant in the programme agree to provide their respective Organizer with the collection of the following personal data by google form and google drive: HeyTap account ID, nickname, email, phone number, and the address collected in order to give you the prize. These data shall be collected and processed by the Organizer to ensure the proper organization and management of the programme i.e. delivery of the Prize.

The Organizer and its affiliated partner respect the Participant’s privacy and undertake to protect it in accordance with their respective privacy policies and the applicable laws.

Personal data will be kept for the time necessary to guarantee the Participant with the exercise of their rights and actions in relation to the programme.

By entering the Activity, you hereby consent that the above Personal data will be collected by us. We will collect, use, disclose, process and protect your personal information according to our privacy policy. You can follow the link below to learn more about our privacy policy as specified in section 2.

Once you participated the programme, it means you agree and acknowledge that realme can accept and check your registration information, collect, process and record your personal data as well as for proceeding this programme or other brand marketing use.   1. LIABILITY AND REPRESENTATION

12.1. ORGANIZER’S REPRESENTATION

Unless otherwise expressly stated in this term, Organizer and its affiliated or third-party Organizers provide the programme on best effort basis only and exclude all warranties and conditions of any kind whether expressly or implied. In particular but without limitation, Organizer and its affiliated or third-party Organizers do not warrant or represent that:

(i) The programme is fit for any purpose or meet Participant requirements or is provided without any errors or deficiencies or that the programme in compliance with any quality levels, as the case may be;

(ii) The programme is available to Participant at any time and provided to Participant without disruption, interruption or delay;

(iii) Any information (whether oral or written) obtained by Participant from Organizer or as a result of Participant taking part in the programme (including any materials or products) will be suitable, accurate, complete, or reliable; and

(iv) That any deficiencies in the programme, including any defects in performance, operation or functionality of the programme will be fixed, corrected or otherwise remedied.

12.2 ORGANIZER’S LIABILITY

Organizer is not liable to Participant, regardless of the legal grounds, in particular whether in contract, tort (including negligence) or any theory of liability, in or out of the connection with the participation in the programme for:

(i) Any indirect, incidental, special or consequential damages;

(ii) Any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect);

(iii) Any damage to and/or corruption or loss of data (whether direct or indirect);

(iv) Any changes, modifications, extensions or limitations (including any suspension of Participant) in the programme.

(v) Access to Participant account and account data or Participant registration data taking part of the programme, or any permanent or temporary cessation in the terms or conditions of the programme (or any part of them).

In the term that Organizer is liable for a breach of these terms, Organizer liability shall be limited to damages which Organizer must typically expect at the time of the conclusion of these Terms due to the circumstances known at the time. Notwithstanding the above, such damages shall not be higher than 100 euros (or equivalent local currency).

Nothing in these Terms shall exclude or limit Organizer:

  1. a) Liability for death, personal injury or fraud or in accordance with any product liability act; and
  2. b) Warranty or liability for damages or losses which may not be lawfully excluded or limited by applicable law. If the laws in the Participant jurisdiction do not allow the exclusion of certain warranties, terms or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or breach of implied terms, or incidental or consequential damages, only the limitations which are lawful in that jurisdiction will apply to the Participant and Organizer’s liability and warranty will be limited to the maximum extent permitted by applicable law.

While realme will use reasonable efforts to include accurate and up to date information on realme ui widget co-creation website, realme makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors) in the content.

12.3. PARTICIPANT’S LIABILITY

Participant is entirely responsible for any breach of the obligations under:

(i) These Terms;

(ii) Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction where you are a resident or from where you are participating in the programme.

(iii) And for the consequences of any such breach, including any loss or damage which Organizer or any third-party may incur or suffer. Organizer will have no responsibility to Participant or to any third party in respect of such breach.

(iv) You agree to abide by the laws and regulations of the People's Republic of China and your own country, and shall not release or upload any form of subversive, pornographic, violent, terrorist, or other illegal information. Submissions that violate applicable laws and regulations or that the organizer regards as disrupting social order or public ethics shall be disqualified from the programme.

(v) Submissions that do not comply with the programme rules contained herein will not be selected for this programme. Should such submissions be selected, they are not exempt from later disqualification, and the organizer is entitled to reclaim the bonuses, awards, medals, written certificates, and other awarded rights and interests, and publicize such action on its official website and other media.

(vi) You agree to authorize the organizer to use your submissions for campaigns and product and brand marketing for free worldwide, including but not limited to using your submissions in network media, print media, printings, photography exhibitions, retail stores, road shows, digital content, out of home media and other marketing activities. Given the foregoing, the organizer shall not issue further notice to inform you or seek your approval when using your submissions. The organizer reserve the rights to sublicense the foregoing rights to its affiliates as well as strategic partners.If you want to use any materials on the 2022 REALME UI WIDGET CO-CREATION website for other purposes, you need to obtain prior consent from realme.

  1. LEGISLATION AND APPLICABLE JURISDICTION

(i) Participation in the programme will be governed by the Terms, which will be interpreted and applied in accordance with the laws of the Organizer. The Participant have the option of filing claims at a competent court in the country in which they are resident.

(ii) Use of and browsing on the site is done at your own risk. Neither realme, nor any other party involved in creating, producing, or delivering the Site, nor any naming right sponsors, event sponsors and third parties affiliated with realme and its partners shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or browsing the site, or downloading of any materials, data, text, images from the site, including, without limitation, damage to, or viruses that may infect, your computer equipment or other property as a result thereof. Without limiting the foregoing, everything on the site is provided to you "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchant ability, fitness for a particular purpose, or non-infringement.

(iii) realme reserves the right to adjust these rules within reason and within accordance with standard practices associated with similar programmes and open gallery calls. Please review these terms regularly to ensure you are aware of any changes made by realme. Your continued use of the site after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

(iv) Any disputes arising from or in connection with this programme shall be negotiated in good faith. If no agreement has been reached, the parties agree to submit the dispute to the People's Court in Nanshan District, Shenzhen for litigation.

(v) Your participation in this programme in part or in full shall be deemed as you having fully understood and accepted all terms and conditions contained herein including programme rules set forth in this section and their interpretations.
