TERMS & CONDITIONS

These terms and conditions (“T&C”) governs the contest titled as “realme VIP Exclusive benefits” (“Contest”) organized, conducted, and brought by Realme Mobile Telecommunication (India) Private Limited (“Organizer”) for the participants interested and consent to participant in the Contest subject to fulfilment of T&C. The T&C shall be in two parts (a) Specific T&Cs for the participation and (b) Basic Terms.

Basic Terms:

Following are the T&C that shall be applicable to the participants:

1) Participation in this Contest is voluntary in nature. The Contest is open for all citizens of India , residing in India, irrespective of their caste, race, ethnicity, colour, sex, religion, sexual orientation, gender identity, family status, disability, medical or genetic condition. Citizens and/or residents of countries other than India are not eligible to participate.

2) The Participant/s must be adults having attained the age of eighteen (18) years to participate in the Contest during the term of the Contest

(All persons fulfilling conditions mentioned in section 1 & 2 shall be hereinafter referred to as “Participants”)

3) To get the exclusive benefits, the participants have to join in realme VIP，followings are benefits list during 2023 diwali:

Specific T&Cs

This activity shall be valid for 37 [THIRTYSEVEN] days, i.e. commencing from [7th October 2023 – 12th November] (both days inclusive) (hereinafter referred to as “Participation dates”)

To participate in the contest, Participants shall note the following points:

This activity shall be valid in 3 waves big sales in diwali，and the time will be announced soon.

Notice:

Note: While participating in the Contest, Participant/s shall ensure that the Entries:

· Shall not violate the rights of any third party, including, but not limited to, privacy rights, copyrights, trademark rights and/or any other intellectual property rights;

· Is not abusive, harmful, harassing, blasphemous, defamatory, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

· Does not violate any law for the time being in force;

· Does not deceive or mislead about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

· Does not contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

· Shall not create any liability for the Organizer or any of its respective parents, subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers and shareholders;

That threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.

4) The Participant by participating in the Contest may or may not stand a chance to enjoy all the benefits.

5) Employees, agents and promoters (including their immediate family members) of Organizer and any of their divisions, affiliates and subsidiaries, and others associated, its advertising, and promotional agencies and its auditors / executing agencies or anyone else professionally connected with the above. With the Contest in any manner, are not eligible to participate in the Contest.

6) The Contest T&C shall be mentioned on the on the official website of Organizer i.e., www.realme.com/in . The Participant/s agree that by participating in the Contest, the Participant/s shall be bound by the T&C provided on the official website of the Organizer.

7) The Participant/s shall be required to provide basic Personal Data about them including but not limited to Participant/ss’s name, address, phone number, social media profile or any other details as may be required by Organizer for the purpose of the Contest, in order to participate in the Contest. The Personal Data provided by the Participant/s in the course of the Contest to Organizer will only be used for Organizer’s internal purposes and to send Participant/ss promotional information in the future pertaining to the Organizer.

8) The specific requirements for the Contest shall be outlined in the T&Cs of the Contest.

9) For the Contest, each Participant/s must submit their complete entry in order to submit their Contest (“Entries”) through Specific Mode of participation specified in Specific T&C’s stated at end of this T&C.

10) Participant/s should ensure the accuracy of the information provided by them at the time of entering the Contest.

11) Please note, the participation in this Contest is free of cost. Organizer does not demand any participation fees or any monies from the Participant/s. If someone pretends to be an officer from realme and demands monies or any other form of identification from you, please do not entertain such request. Such a person is defrauding you and you should report this to the local police immediately. There are also no lotteries, prize monies, cash prizes etc. distributed by the Organizer. The only to participate in the Contest is in the manner detailed hereunder and any person who claims to be from Organizer and offers any lotteries, prize monies, cash prizes etc. to anyone is defrauding the person and you should report this to the local police immediately.

12) Participant/s shall not post any profanity or abusive comments on the respective social media pages of the Organizer for in any other manner. In the event of any such profanity or abusive comments posted on foregoing pages, such Participant/s shall be disqualified forthwith and Organizer reserves its rights, in addition to removing such post, to take a legal action against such Participant/s and/or user.

13) Participant/s agree no clarifications on the questions and the answers used in the Contest shall be entertained by Organizer.

14) By entering into the Contest, the Participant/s waive all copyrights including but not limited to Intellectual Property Rights (IPR) and moral rights, rights of publicity and any related rights and consents to Organizer’s right to use the images, pictures, posts, paintings, comments etc. uploaded by the Participant/s for the Contest (“Materials”), picture, tape or portray him/her as a Participant/s, use the their profile pictures and social media handles, and to exhibit this material in any and all media now existing or hereinafter created, including without limitation television, film, radio and print media, without any compensation whatsoever for advertising and publicity purposes, except where prohibited by law. The Participant/ss also consent to Organizer’s right to use his/her name, voice or picture, or the content of his/her Contest Entry (collectively, the “Publicity Rights”). Organizer can allow to its agencies to exercise/exploit the Publicity Rights in conjunction with Organizer. Organizer shall also be free to use any ideas, concepts, know-how or techniques contained in the entries received for the Contest for any purpose.

15) By entering into the Contest, the Participant/ss hereby provides Organizer shall have the unrestricted, unfettered, royalty-free, perpetual, irrevocable, sub-licensable, sub-assignable right to exploit the Materials, in any manner whatsoever, across all modes, mediums and platforms and in all languages, without any claims from the Participant/s.

16) You hereby specifically consent to Organizer collecting and processing your email ids or other Personal Data for the purposes of this Contest. The email ids and comments collected from the Participant/s, shall be retained by Organizer till the end of the Contest and shall be deleted from Organizer’s servers post the completion of the Contest.

17) Organizer shall keep all the Personal Data collected from the Participant’s confidential. Organizer shall ensure that the Participant/s are contacted by Organizer and Organizer shall not share the Personal Data so collected with any party, save and except for the purpose of the present Contest. The Participant/ss hereby consent to the collection, storage, use, disclosure, transfer, of Personal Data which may be collected by Organizer for the purposes of this Contest. The Participant/s hereby agree and acknowledge that the collection, storage, use, disclosure, transfer, of the Personal Data by Organizer is for a lawful purpose and is necessary for facilitating your participation in the Contest. The Participant/s’s by providing the aforesaid Personal Data hereby agree that Organizer shall have the right to share the Personal Data so collected with such other third party and Organizer as required for the purpose of the Contest and hereby agreed that they shall not file any claim against Organizer for sharing for such Personal Data. Please refer to Organizer’s Privacy Policy https://www.realme.com/in/legal/privacy-policy that governs the use of your Personal Data. Participant/s entering into this Contest agree and acknowledge the T&C, Privacy Policy.

18) All personal information, images and documents collected by the Organizers from the Participants shall also be used by the Organizers for the purposes connected with this Contest including but not limited to conducting verification (including third party verification), etc and all such documents and information so collected shall become the property of the Organizer. The Participants hereby agree that they are providing their personal information and documents to the Organizers out of their own will, and they shall have no claims against the Organizers or anyone associated with the Organizer for using their personal information, images and documents for any purpose connected with the Contest or in the manner prescribed under Organizer data privacy policy mentioned herein above.

19) The Winners of the Contest shall win Prizes based at the sole discretion of Organizer.

20) If the entry is not placed during the above-mentioned Claim Period, Organiser has the right to forfeit the Prize.

21) Organizer and/or its licensors and/or its rights holders shall not be responsible or liable for any technical disruption and/or failure and/ or any other difficulties of such nature, due to which the Winner is unreachable or any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which realme is unable to intimate the Winner.

22) The Participants agree and accept that they can deny, refuse, or withdraw their consent from sharing any data provided by them, by contacting to the Organizer in writing in which case the Participants forfeits its right to participate in the Contest including any winnings and the Organizers, too, reserve the right of disqualifying the Participants/Winners.

23) For the purposes of the Contest, Organizer may contract with the service providers to perform functions or services on its behalf. Such service provider may have limited access to the Participant/s(s) Personal Data needed to perform their functions, but shall be restricted from using such Personal Data for purposes other than providing services to Organizer solely in connection with the Contest. Organizer shall ensure, on reasonable efforts basis, that its service providers that have limited access to Personal Data provided by the Participant/ss(s) to provide the services or perform their function for Organizer, are subject to the same level of privacy protection as is required by the applicable laws. The Participant/s(s) hereby agreed that they shall not file any claim against Organizer for sharing for such Personal Data.

24) Organizer shall deal with any Personal Data, if any, that it receives from Organizer or otherwise collects, holds, uses and processes in the following manner: a) Organizer may also disclose Personal Data, if any, to governmental agencies and regulators (e.g., tax authorities), social organizations (e.g., the social security administration), human resources benefits providers (e.g., health insurers), external advisors (e.g., lawyers, accountants, and auditors), courts and other tribunals, and government authorities, to the extent required or permitted by applicable legal obligations upon prior written approval from Organizer. b) The level of data protection using technical, managerial, operational and physical security control measures by Organizer shall be such as to be in compliance with all applicable laws. c) The term “Personal Data” shall mean and include the name and contact information (home address, telephone and fax numbers and email address), valid identity proof such as passport number, driver’s license number, permanent account numbers, social security numbers or other details pertaining to the identity of the Participant/ss and shall include sensitive personal information.

25) Participant/s confirm that the comments and answers uploaded by them or any part thereof do not infringe upon the statutory rights, common law rights, intellectual property rights including copyrights in literary, dramatic, musical or motion picture rights, patent rights or the trademark or trade names of any person, firm, corporation, association or entity whatsoever. Neither the comments nor any part thereof violate the statutory rights of, or the right of privacy, or constitute a libel or slander against any person, firm, corporation, association or entity whatsoever, or violate any other rights not herein specifically enumerated. No comments or any part thereof shall be defamatory or contribute contempt of court or breach of contract, or breach of any provision of statute, nor hurt the sentiments of religious groups. In the event of any infringement and/or any unlawful usage of any Personal Data including pictures provided by the Participant/s, Organizer shall not be held liable on any account whatsoever.

26) Organizer including its divisions, affiliates and subsidiaries, and their respective agents and representatives, employees shall not be responsible for any loss of Entries for any reason whatsoever including, due to any technical problems for Entries received after the deadline as a consequence of computer service delays, interruptions, electronic failures or overloads, or for lost, misdirected or misplaced Entries or any lost, late or misdirected computer transmission or network, electronic failures of any kind or any failure to receive entries owing to transmission failures or due to any technical reasons. The Entries are void if unreadable, inaccurate, incomplete, damaged, tampered with, falsified, mechanically reproduced, not in prescribed format, irregular in any way or otherwise not in compliance with these Terms and Conditions.

27) Organizer and/or its licensors and/or its rights holders shall not be responsible or liable for any technical disruption and/or failure and/ or any other difficulties of such nature, due to which the Winner is unreachable or any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which realme is unable to intimate the Winner.

28) Organizer has the right to amend (add, delete or modify) the T&C governing the Contest, prospectively or retrospectively, at its discretion and without prior notice.

29) Organizer is not responsible for any errors or omissions in the terms and conditions contained herein. All Prize(s) are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). In the event the Winners do not accept or agree to the T&C as stated herein, the Prize shall remain with realme, who on its own discretion may offer the same to the next eligible winner. For the purpose of clarity, no cash equivalent or alternative prize will be given to the Winner and the Winner cannot exchange the Prize for a gift of similar value. The Winner shall not sell, license or commercialize the Prize in any way.

30) The Participant/s shall fully indemnify, defend and hold harmless, Organizer its affiliates, officers, directors, employees and agents (collectively the “Indemnified Persons”) from and against any and all losses, claims, actions, damages, liabilities, penalties, costs and expenses, (including without limitation reasonable attorneys’ fees and court fees) (collectively “Losses”), that the Indemnified Person may incur or suffer or likely to incur or suffer as a result of or arising out any (i) breach of any terms hereunder; (ii) wilful misconduct or negligent acts or omissions; (iii) any claims by any third party for any losses, damages, costs, expenses, injuries suffered by such third party, arising out of or in relation to the Participant/s.

31) Under no circumstance, unless due to wilful misconduct or gross negligence, shall Organizer and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Participant/ss and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever. The Participant/ss specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against Organizer their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest.

32) Organizer does not make any commitment, express or implied, to respond to any feedback, suggestion and, or queries of the Participant/s or furnish any reason or explanation for inclusion and, or, exclusion of any particular submission of the Entry of a Participant/ss at any stage of the Contest.

33) Organizer reserves the right to withdraw or discontinue and/or terminate the Contest at any stage without prior notice and without any liability whatsoever to the Participant/s.

34) The decisions of Organizer and its representatives shall be final and binding on all aspects of the Contest.

35) Your participation in the Contest by posting the Entries will be deemed as an acceptance of the above stated T&C.

36) The Contest is void where prohibited by law. All relevant national and local laws apply.

37) The Contest shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Contest are subject to the jurisdiction of the Courts at Gurgaon (Haryana) only.

39) Organizer assumes no liability or responsibility for (i) any errors, omissions or inaccuracies of contest or submissions, (ii) Any unauthorized access to or use of our secure servers and/or any and all personal information that may be contained therein. (iii)Any deletion of data or interruption or discontinuance of transmission to or from during the contest.

40) Each participant must be careful in providing their information. In case the participant provides inaccurate and/or false information, the entire coupon prize would be forfeited or will be passed on to another participant without any further communication with the claimant. The Organizers shall have the sole discretion in this regard.

41) It is clarified that in case the winner become disqualified on account of any Government restriction, winner regulations, norms, policy etc., in such case Winner shall not have any claim against Organizer for the same and shall be deemed to have availed of his/her prize.

42) Entries are deemed to be submitted at the time of receipt of the entry into the Organizer database, and not at the time of transmission by the participants. The database maintained by the Organizer shall be considered final and no correspondence in this regard shall be entertained.

43) Coupon/Prizes are non-transferable. No cash or any other claim can be made in lieu of prizes.

44) Conducting this Contest is prohibited in the state of Tamil Nadu and thus, users residing in the state of Tamil Nadu or any state of territory, where contest is prohibited are not eligible to participate in this Offer.

45) Any costs or expenses incurred to participate in the contest and/or to claim the Prize, if any and as applicable shall be solely borne by the Winner and Organizer shall not be liable for any such costs or expenses.

46) This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, and act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of the Organizers (the Force Majeure Event”). The Organizers shall not be liable for any delay or adverse effect which may be caused to this contest and its participants as a result of a Force Majeure Event.
