Terms & Conditions – 50Lakh Crazy Giveaway

These terms and conditions ("Terms") govern the conduct of the draw titled as “#realme 50Lakh Crazy Giveaway” ("Contest") organized, conducted and brought to the Participant(s) by Realme Mobile Telecommunications (India) Private Limited ("Organizer" or “REALME”). “Participants” herein refer to as the purchasers of REALME mobile phones and activating the REALME mobile phones during 25th September, 2023 12:00 PM IST till 20th November, 2023 23:59 PM IST (herein after referred to as the “Event Duration”).

Eligibility:

1. Purchase of a new mobile phone of realme during 25^thSep 2023 to 20^th Nov 2023.
2. After the purchase of the realme phone, the participants will have to activate the new phone.
3. To participate in #realme 50Lakh Crazy Giveaway, the participants will play the Contest on realme Store App, within the event duration.
4. Login/Register to realme Store.
5. Enter 50Lakh Crazy Giveaway page through the 50Lakh Crazy Giveaway banner.
6. In the 50Lakh Crazy Giveaway page, the IMEI code of the purchased will be automatically read.
7. One realme account can play the Contest after the purchase of a new realme Phone.
8. The Participants will have to strictly follow the Eligibility process during the Event Duration and only thereafter the Participants playing the Contest will be considered eligible.
9. This Contest is not applicable in the State of Tamil Nadu or any other State or Territory of India, where Contest is prohibited.
10. The users who purchase the realme smartphone from offline channel will join on the offline platform to participate in this contest (Not on the realme App Store)

Timelines:

1. The Contest will be applicable to only those purchasers who are eligible as per the terms mentioned under the sub-heading Eligibility.
2. The Participants will get to know about the prizes which they have won immediately after playing in the contest, however, the redemption of the same shall be as per the sub-heading Redemption Mechanism/Scheme given herein below.

Prize:

1. The Participants by playing the Contest may or may not stand a chance to win one of the prizes mentioned below.
2. The total value of the prizes is around 50L whilethe cashback prizes up to 31.5 Lakh. The total value of the contest includes online channel and offline channel.
3. The cashback prizes willbe distributed in three phases.

For each phase

1. INR 1 lakh worth of e-gift card(s) x 3 users. (2Lfor online channel /1L for offline channel) [Excluding Tax deductions] *
2. INR 50 thousand worth of e-gift card(s) x 15 users (5L for online channel/2.5L for offline channel)[Excluding Tax deductions] *
3. Coupons & IoT Products

For all of the three phases combined:

1. INR 1 lakh worth of e-gift card(s) x 9 users [Excluding Tax deductions] *
2. INR 50 thousand worth of e-gift card(s) x 45 users [Excluding Tax deductions]*
3.   Coupons & IoT Products worth 20 lakh

* Tax Deduction at Source will be deducted as per the applicable tax rate of 31.20% which will be deducted from the aforementioned e-gift card value and Winner will get the e-gift card after deducting mentioned applicable tax i.e. For every cash prize of Rs. 100, Winner will get e-gift card of Rs. 68.80

*The offline channel cashback prizes may vary depending on the stores, but the total value follows the aforementioned T&Cs.

2. The Participants agree that there are no guarantees that the Participants will win any of the above prizes. The participants further agree that realme has the right to change any of the aforementioned prizes at any given point in time, at its own discretion and without any prior intimation to anyone, in any manner whatsoever. The Participants also agree that the decision of REALME shall be final and non-challengeable in respect of any of the prizes mentioned herein above or in case of any dispute in respect of the aforesaid prizes in any manner whatsoever.

Redemption Mechanism/Scheme:

1. To participate in the Contest the Participants can go directly to realme Store App. Subsequently, the Participants will be directed to the Contest page through the contest banner. There the Participants will find a 50L Crazy Giveaway banner, by just clicking on the banner the Participants can win prizes by a draw conducted by applying a random algorithm amongst the entries received.The users who purchase the realme smartphone offline channel will join on the offline platform to participate in this contest
2. The e-gift card(s) Winner will have to fill all desired information as provided on realme Store App and thereafter will have to visit their nearby showroom (as communicated) to give their bank details along with a canceled cheque and all other documents as may be required by REALME. The E-gift card(s) Winner will have to participate in various promotional activities organized by REALME. If the e-gift card(s) Winner refuses to provide its information, perform such promotional activities as and when and in the manner required by REALME, then the E-gift card(s) Winner, automatically and irrevocably forfeits its right of receiving any E-gift card(s) Winnings and the E-gift card(s) Winner thereon will be disqualified by REALME. Once the winner of the E-gift card(s) Prize has provided all the details, REALME will transfer the E-gift card(s) Prize within one-month (after deduction of applicable taxes).
3. 3.Winners can receive a redemption coupon which can be redeemed for purchasing the said IoT and smartphones at the online realme Store. The Participants can use the redemption code for the IoT latest by 30^thDecember 2023, thereafter, the redemption code will expire.
4. Upon winning the realme coins, the said realme coins will automatically be reflected in the user account of realme Store App. The Points can be checked by the winners in “Reward Points History” of realme Store App.
5.    All Participants agree that if they fail to follow any of the redemption procedures or any additional procedures or processes advised by REALME then they shall unequivocally and irrevocably forfeit their winnings and that REALME shall disqualify such winners. The Participants shall not raise any dispute or challenge REALME’s decision in this regard and each such Participant shall keep REALME completely indemnified (including but not limited for all its costs, expenses, penalties, interest, etc.) and held harmless in this regard.

Taxes:

The Participants agree that in case there is/ are any taxes which is/ are required to be paid in respect of or in connection with any prizes mentioned herein then the same shall be solely borne by the Participants and that the Participants shall completely indemnify (including but not limited for all its costs, expenses, penalties, interest, etc.), defend and hold harmless REALME, its employees, its directors and shareholders in all such aspects.

The Participants undertake and acknowledges that REALME is not liable to bear any of the taxes in respect of the prizes in any manner whatsoever and in case REALME is required to pay any taxes in respect of any such winning then REALME reserves the right to recover all such amounts from the Participants along with all legal and other cost and expenses incurred by REALME along with the Indemnity provided herein.

The Participants further agree that a refusal or reluctance, explicit or implicit or whether directly or indirectly, to pay and bear the taxes in respect of the prizes shall give an unequivocal right to REALME to disqualify the Participant without the Participant having any claim on REALME, in any manner, whatsoever.

The aforesaid Prize money shall be subject to necessary deduction of tax at source as per the applicable provisions of the Income-Tax Act, 1961. The winner shall provide requisite documents in this regard to REALME.

Data Privacy:

1. By participating in this Contest the Participant hereby unequivocally and irrevocably grant the Organizer it's free consent and a right to collect, store, process, use, share, transfer, publish the personal data (including images, videos, documents, etc.) provided by the Participant on any medium and mode and in the manner as may be desired by the Organizer in accordance with the data privacy notice of REALME available athttps://www.realme.com/in/legal/privacy-policy.
2. All personal information, images and documents collected by the Organizers from the Participants shall also be used by the Organizers for the purposes connected with this Contest including but not limited to conducting verification (including third party verification), etc. and all such documents and information so collected shall become the property of the Organizer. The Participants hereby agree that they are providing their personal information and documents to the Organizers out of their own will, and they shall have no claims against the Organizers or anyone associated with the Organizer for using their personal information, images and documents for any purpose connected with the Contest or in the manner prescribed under REALME’s data privacy policy mentioned herein above. Further, the Participants absolve the Organizer and anyone associated with the Organizer in case any personal information and documents of the Participants are misused by any third party whose actions cannot be effectively controlled by the Organizers.
3. The Participants agree and accept that they can deny, refuse, or withdraw their consent from sharing any data provided by them, by contacting to the Organizer in writing in which case the Participants forfeits its right to participate in the Contest including any winnings and the Organizers, too, reserve the right of disqualifying the Participants/Winners.
4. The Participants hereby, unequivocally, and irrevocably accept all the Data Privacy clauses/terms as explicitly mentionedand in the Company Privacy Policy https://www.realme.com/in/legal/privacy-policy.

Confidentiality:

1. Notification of the ‘Winner’ status must be kept confidential by the Participants who have won and may be contacted/ intimated by the Organizers. The Confidentiality of winning in the Contest shall be maintained by the Participants until the Winners are publicly revealed by the Organizer otherwise REALME, at its discretion, reserves the right to disqualify the Participants and the Participants prize shall be forfeited and the same shall be final and binding and no correspondence in this regard shall be entertained.

General Terms:

1. By participating in this Contest, the Participants unequivocally and irrevocably accept the Terms of the Contest as specified herein or as may be as updated/ amended by the Organizer from time to time.
2. The Organizer reserves the right to verify on its own or through any third party, at any time whether the Participants actually purchased realme mobile phones during the Event Duration or not, and in case the Organizer finds that the product was not purchased during the Event Duration, or the Participants has not complied with these terms and conditions, then the Organizer has the right and liberty to disqualify any Participant.
3. The Organizers may contact the Participants on their registered number or Email ID as provided by the Participants at the time of enrollment for the Contest and the Organizers may, as a pre-requisite, ask the Participants to submit documents like proof of ID, Age, PAN Card, etc., on such terms as may be required by the Organizers before any of the prize can be released in favor of the winner. Any default in submitting the required documents or submission of illegible, false, or forged documents shall automatically disqualify the winner without any further intimation require from the Organizers and the Organizer, unconditionally, shall be at a liberty to forfeit the prize. After verification, the prize winner may be informed about the entire process of redemption of the prize. Organizer assumes no liability or responsibility for (i) Any errors, omissions or inaccuracies in the personal information including contact details and documents provided by the Participants; (ii) Any unauthorized access to or use of the Organizer secure servers and/or any and all personal information and/or financial information that may be contained therein. (iii) Any deletion of data or interruption or discontinuance of transmission to or from or through the Promotion.
4. Award of prizes is subject to the verification of the documents of the Participants by the Organizers or any third party appointed by the Organizers and the Participants hereby give their consent to the Organizers for the use of their documents and personal information for the said purposes.
5. It is clarified that in case the Participant become disqualified on account of any Government restriction, winner regulations, norms, policy, etc., in such case Winner shall not have any claim against Organizer for the same and shall be deemed to have availed of his/her prize.
6. At the Organizer’s request, winners must participate in all promotional activities (such as publicity and photography) surrounding or connected with the Contest and winning of the prize, and they unequivocally provide their consent to the Organizer for making and/ or using their name, likeness, video, image and/or voice in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this Contest (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Organizer.
7. Decisions of Organizer's will be final and binding with regard to the Contest and prizes and no correspondence shall be entertained in this regard.
8. Prizes are non-transferable. No cash or any other claim can be made in lieu of prizes.
9. Any costs or expenses incurred to participate in the Contest and/or to claim the Prize, if any and as applicable shall be solely borne by the Winner and Organizer shall not be liable for any such costs or expenses.
10. Organizers reserve the right to cancel, modify, extend or withdraw the Contest at its sole and absolute discretion without giving prior notice. It shall be the sole responsibility of the Participant(s) to check the Terms from time to time.
11. The Organizer accepts no responsibility for any tax implications that may arise from the prize winnings. Winners will have to bear incidental costs, if any, that may arise for redemption of the prize.
12. Organizer shall not be liable for any direct or indirect loss or damage whatsoever that may be suffered as a result of participating in this Contest.
13. This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, lock down, pandemic, government orders political unrests, technical snags, act of God or any circumstance beyond the reasonable control of the Organizer (the “Force Majeure Event”). The Organizer shall not be liable for any delay or adverse effect which may be caused to this Contest and its Participants as a result of a Force Majeure Event.
14. The Participants agree and acknowledge that the Organizer do not provide any warranties or guarantees in respect of merchantability, quality of the goods or services being offered in connection with the gratification nor are the Organizers liable for any defect or deficiency of goods or services so obtained/ availed by the Participants and winners in pursuance of this Contest. The Prizes are not supported with any warranties or guarantees offered by REALME. If any Participants have any grievance with respect to the prize, he/she may directly contact manufacturer.
15. By participating in the Contest, each Participant confirms and waives the applicability of rules and regulations of TRAI pertaining to the National Do Not Call Registry and Unsolicited Commercial Communication pertaining to activities conducted by the Organizer in connection with this Contest and that each Participant agrees to receive engagement messages, calls and alerts including without limitation any updates pertaining to this Contest from and/ or on behalf of the Organizers as they may, in their sole and absolute discretion, decide.
16. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Gurgaon (Haryana) only.
17. Participants shall comply with these terms and conditions and waives any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Organizer and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from in this Contest or in redemption of any Prizes under this Contest.
18. This Contest is not applicable to REALME employees and their immediate relatives REALME distributors and dealers and their respective employees and their immediate relatives.
