Organizer representation: Unless expressly stated otherwise in these terms, the Organizer and its affiliated or third-party organizers provide the Promotion solely on the basis of best effort and exclude all warranties and conditions of any kind, whether express or implied. In particular, but without limitation, the Organizer and its affiliated Organizers or third parties do not guarantee or represent that:

• The Promotion is suitable for any purpose or meets the requirements of the Users or is provided without any error or deficiency or that the Promotion meets any level of quality, as the case may be;
• The Promotion is available to the User during the period of time specified in point 6 and is provided to the User without interruption, interruption or delay ;
• Any information (whether oral or written) obtained by the User of the Organizer or as a result of the participation of the Users in the Promotion (including any material or product) will be adequate, accurate, complete or reliable; and
• That any deficiency in the Promotion, including any defect in the operation, operation or functionality of the Promotion will be corrected, corrected or otherwise remedied.

9.2. Responsibility of the organizer: The Organizer is not responsible to the User, regardless of legal reasons, particularly if in the contract, tort (including negligence) or any theory of responsibility, inside or outside the connection with participation in the Promotion for :

• Any indirect, incidental, special or consequential damage;
• Any loss of income, business, real or anticipated gains, opportunity, goodwill or reputation (either direct or indirect);
• Any damage and / or corruption or loss of data (either direct or indirect);
• Any change, modification, extension or limitation (including any suspension of Users) in the Promotion;
• Access to the User's account and the account data or the User's registration data) participating in the Promotion, or any permanent or temporary interruption of the terms and conditions of the Promotion (or any part of them).

In the event that the Organizer is responsible for the breach of these terms, the Organizer's liability will be limited to the damages that the Organizer should typically expect at the time of the conclusion of these terms due to the circumstances known at the time. However, the foregoing, such damages may not exceed one hundred euros (100€) (or its equivalent in local currency).

Nothing in these terms will exclude or limit the Organizer:

• Liability for death, personal injury or fraud or in accordance with any law of liability for defective products; and
• Guarantee or responsibility for damages or losses that cannot be legally excluded or limited by the applicable law. If the laws of the jurisdiction of the Users do not allow the exclusion of certain guarantees, terms or conditions or the limitation or exclusion of liability for losses or damages caused by negligence, breach of contract or breach of implicit terms, or incidental or consequential damages, only the limitations that are legal in that jurisdiction will apply to the liability and guarantee of the Users and the Organizer will be limited to the maximum extent permitted by applicable law.

9.3. Responsibility of Users: The User is entirely responsible for any breach of obligations arising from:

• These terms;
• Any applicable law or regulation in the relevant jurisdictions, including the jurisdiction in which you reside or in which you participate in the Promotion, and
• For the consequences of said breach, including any loss or damage that the Organizer or any third party may suffer. The Organizer will not be responsible to the User or third parties for said breach.

10. APPLICABLE LEGISLATION AND JURISDICTION

Participation in the Promotion will be governed by the T&C, which will be interpreted and applied in accordance with the legislation of Spain. The User has the option to file claims with a competent court in the country in which he resides.
